These Terms of Service (“Terms”) govern your use of auvie.com (the “Site”) and your purchase and use of products and services made available through the Site.
The Site and auvie products and services offered through it are operated by EARTHNOTE TECHNOLOGIES (UK) LIMITED, trading as auvie (“auvie”, “we”, “us” or “our”), a company registered in England and Wales under company number 15216366.
By accessing our Site or purchasing from us, you agree to these Terms.
Nothing in these Terms affects any statutory rights you may have as a consumer under applicable law.
1.Online Store
You may use our Site only for lawful purposes and in accordance with these Terms.
You are responsible for ensuring that the information you provide when placing an order is accurate and complete.
We reserve the right to refuse or cancel an order where reasonably necessary, including where a product is unavailable, pricing or product information contains an obvious error, payment cannot be authorised, or we reasonably suspect fraud or misuse.
If we cancel an order after payment has been taken, the relevant amount will be refunded.
2.Products and Product Information
We make reasonable efforts to display product descriptions, specifications, images and colours accurately.
Actual product appearance may vary slightly depending on your screen, device or reasonable manufacturing variations.
We may update or modify products, packaging, specifications or product availability from time to time, provided this does not affect your statutory rights.
3.Product Use and Pods
auvie devices and Pods should only be used in accordance with the instructions supplied with the product.
Pods are designed for use with compatible auvie devices and should not be opened, modified, refilled, tampered with or used in a manner inconsistent with the product instructions.
For hygiene, safety and product-integrity reasons, Pods that have been opened, activated or used are not eligible for change-of-mind returns, unless the product is faulty, defective, incorrectly supplied, or applicable consumer law provides otherwise.
Please review all product information, ingredient information and usage instructions before use.
4.Health and Wellness Information
auvie products are designed to support everyday wellness experiences.
Information provided through our Site, products, content or Services is for general informational and wellness purposes and should not be considered medical advice, diagnosis or treatment.
Our products and Services are not intended to replace professional medical care.
If you have a medical condition, are taking medication, are pregnant or breastfeeding, have known allergies or sensitivities, or have concerns about whether a product is appropriate for you, you should seek appropriate professional advice before use.
Always follow the product instructions and safety information provided.
5.Prices and Payment
Prices displayed on the Site are shown in the applicable currency for your market.
For UK consumer orders, applicable VAT is included in the purchase price where required.
For other markets, applicable taxes, duties or charges will be displayed or otherwise communicated where required.
You agree to provide current, complete and accurate payment and billing information.
Payment must be successfully authorised before an order can be processed.
6.Orders
After placing an order, you will receive an order confirmation.
Receipt of an order confirmation does not necessarily mean that we have accepted your order. A contract is formed when we accept and process your order in accordance with applicable law.
We reserve the right to limit quantities where reasonably necessary, including to prevent unauthorised resale or misuse.

Shipping availability, costs and estimated delivery times vary by destination.

Delivery dates are estimates unless expressly stated otherwise.
Your statutory rights relating to delivery remain unaffected.
8.Returns and Refunds
We offer a 14-day return period, subject to the eligibility conditions set out in our Returns & Refund Policy.
Eligible auvie devices may be returned in accordance with that policy.
Unused Pods may be eligible for return provided that their individual seals remain intact and they have not been activated or used.
For hygiene, safety and product-integrity reasons, Pods that have been opened, activated or used are not eligible for change-of-mind returns.
This does not affect your rights where a product is faulty, defective, damaged, incorrectly supplied or otherwise not as described.
Nothing in our Returns & Refund Policy limits or replaces any cancellation, return, refund or other rights available to you under applicable UK or EU consumer law.
9.Intellectual Property
All content available through the Site, including trademarks, trade names, logos, product designs, text, graphics, images, videos, software and other materials, is owned by or licensed to auvie, EARTHNOTE TECHNOLOGIES (UK) LIMITED, or their relevant affiliates and licensors and is protected by applicable intellectual property laws.
You may use the Site for personal, non-commercial purposes only unless we expressly agree otherwise.
Nothing in these Terms grants you any right to use the auvie name, trademarks, product designs or other intellectual property for commercial purposes.
10.Third-Party Services and Links
Our Site may contain links to or integrations with third-party websites, payment providers or other services.
We are not responsible for third-party services that we do not control. Your use of those services may be subject to separate terms and privacy policies.
11.Prohibited Use
You must not use our Site or Services:

If you are purchasing as a consumer, nothing in these Terms affects your statutory rights.

Any such changes will not affect rights you have in relation to orders already accepted by us, except where required by law.
